SAMSUNG GALAXY CAMERA "THIS IS MY MOMENT, LIVE" 2012 CAMPAIGN TERMS & CONDITIONS

Campaign overview

• SAMSUNG GALAXY CAMERA "THIS IS MY MOMENT, LIVE" 2012 campaign is a web-based activity, organised by Samsung Malaysia Electronics (SME) Sdn Bhd (“Samsung”), where eligible participants may snap and share their photos with the general public. A reward will be given to the 5 most creative submissions (see Prizes).

The Objectives

• The campaign aims to create awareness of the Samsung GALAXY Camera and drive purchase consideration.

Campaign Period

• The SAMSUNG GALAXY CAMERA “THIS IS MY MOMENT, LIVE” 2012 campaign (“the Campaign”) will run from 20 December 2012 to 01 January 2012 (“Campaign Period”). Samsung Malaysia Electronics (SME) Sdn Bhd shall reserve the right to shorten or extend the Campaign Period.
• All entries must be received by our system between Thursday 00:00:00 20 December 2012 to Sunday 23:59:59 01 January 2013 (Malaysian Time) to qualify for the Campaign submission. Late and invalid submissions will not be entertained. The time is based on our server's system time.

Consumer Mechanics

• Participants need to go through the following 3 steps to take part:
  • Step 1: Visit www.thisismymoment.com (“the Website”) and submit at least one (1) photo via either one of the two upload methods detailed on the Website.
  • Step 2: Complete the submission process, whereby they will have to provide their Full Name, IC Number, Address, Mobile Number, E-mail, and Agree to the Terms & Conditions of the Campaign.
  • Step 3: Samsung will contact participants who have been selected for the reward.
• Participants may submit as many photos as they wish during the campaign period, on any day or time, and regardless of the day’s chosen theme.
• Participants are solely responsible for the photo(s) they submit or allowed to be included in the Campaign, including all copyrights and/or legal rights to said photo(s). Samsung will not be held responsible for any dispute, legal or otherwise, arising from the photo(s) submitted.
• Participants may not include in the submission pornography, symbols or words inciting racism, political affiliations, slander, or any other element deemed inappropriate. In addition, participants should only include photos and not illustrated versions or other such artistic renderings (i.e. cartoon avatars). Such submissions will be summarily deleted without notice to the participant. Illustrated versions or other such artistic renderings (i.e. cartoon avatars) will only be accepted if deemed and accepted as part of a photograph. Samsung makes no guarantees that a submission will be approved and are under no obligations to inform participants if their submissions have been rejected. No correspondence will be entertained on the status of any submission.
• Each participant shall only be entitled to ONE (1) reward in this Campaign.

Winner Selection:

• Judging criteria is based on each submission’s accuracy and creativity in expressing a chosen theme as well as technical skill in achieving that expression.
• Five (5) participants will be selected to receive the prizes at the end of the Campaign period at Samsung’s complete discretion.
• Samsung's decision is final. No further correspondence or appeal will be entertained.
• Participants whose submissions are selected will be notified via email and the respective reward will be delivered to the address provided by the participants after the participants have been contacted.
• Samsung reserves the right to reject any entries that are incorrect, incomplete, suspicious or invalid.
• Samsung reserves the right to reject any entry at its sole and absolute discretion without having to assign any reasons whatsoever.
• Samsung reserves the right to request proof of IC number and age of any winner before the prize is dispatched or collected. Samsung reserves the right to forfeit prizes for any winner who does not provide the required details upon receiving the request/notification from Samsung.

Winners’ Obligations:

• The five winners selected at the end of the Campaign period will be rewarded with a GALAXY Camera each.
• Upon receiving the GALAXY Camera, the 5 winners are required to snap and share a photo with their new Galaxy Camera, and post it on their Facebook wall within a week.
• The winners are free to pick any event or moment for their photo but Samsung will provide the captions when they post the photo on Facebook.
• In the event Samsung organises a prize-giving ceremony at a venue designated by Samsung, the winners are required to attend at their own expense to claim their prize. In the event a winner is not able to attend, the winner must nominate a representative to be present and accept the prize on his/her behalf. Failure to attend the prize giving ceremony may result in forfeiture of the prize(s).
• Their photos and/or submissions may also be featured in any Samsung advertisement.

Prizes

• Prize x 5:
  • Samsung GALAXY Camera worth RM1899, with battery and etc.
  • The selected photos may also be featured in our new advertisement.

Prize Collection

• The eligible winners will be contacted via telephone. Should the first attempt to call the winner fail, i.e. no reply, telephone number not in service or no connection, etc, another three (3) attempts will be made within the next 24 hours of the first telephone call. Where such further attempts are unsuccessful, Samsung reserves the right to select the next qualified participant. Samsung will not be held liable in the event the eligible winners cannot be contacted for whatever reasons.
• Eligible winners will be required to provide their IC number as identification in order to claim the prize.
• Each participant is entitled to win only one (1) prize during the Campaign Period.
• All prizes must be claimed at participants’ own expense within 30 days after the Campaign Period. All unclaimed prizes will be forfeited by Samsung 30 days after the Campaign Period.

Other Terms and Conditions

Eligibility

• 5. This Campaign is open to residents of Malaysia and permanent residents with valid NRIC. Participating in the Campaign constitutes acknowledgement that these requirements are met.
• The following group of persons may participate in the Campaign but shall not be eligible to win prizes in the Campaign:
  • Employees of Samsung including its affiliated and related companies and their immediate family members (children, parents, brothers and sisters, including spouses; and/or
  • Representatives, employees, servants and/or agents of advertising and/or promotion service providers of Samsung including its affiliated and related companies, and their immediate family members (children, parents, brothers and sisters including spouses).
• Winners under the age of 18 years old must obtain the consent of their parents or legal guardian before redeeming the prize.
• Samsung reserves the right to substitute any prize with another of similar value without prior notice. All prizes are not transferable, non-refundable and non-exchangeable for cash.

Liability and Responsibility

• Winners shall assume full responsibility in case of any accident, damage or claim resulting from participation in this Campaign and/or usage of the prizes.
• All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to redeem the prize are the sole responsibility of the winners.
• Any surcharges/tax in relation to prizes at the time of redemption must be borne by the recipients.
• By participating in the Campaign, each participant agrees to release and hold Samsung and its employees, officers, directors, shareholders, agents, representatives, parent companies affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims, expenses (including but not limited to legal fees) and actions of any kind in connection with the Campaign or resulting from participants’: (i) use and access to the Campaign and Campaign website, (ii) violation of any of these Terms & Conditions, (iii) violation of any third party right, including without limitation any copyright, property, privacy right, or any claim that the participants’ submission(s) cause damage to a third party, and (iv) acceptance, possession, use or misuse of the prize, or travel to or from any gift-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Terms of Participation

• By participating in this Contest, participants fully and unconditionally agree to and accept the official Rules and Regulations and decisions of the Organiser and explicitly consents to her/his name and picture being published on the Internet (homepage and Facebook site of the organizer) and possibly also in the print media of the organizer in the event of winning.
• Organiser’s decision is final. Correspondence will not be entertained.
• The Organiser reserves the right to amend these Terms and Conditions without giving prior notice.

Rights of Samsung as the Campaign Organiser

• 1. Acceptance of prize constitutes permission to Samsung and its agencies to use the winners’ names and/or photographs for purposes of publicity, advertising and/or trade without further compensation or notice.
• Samsung reserves the right to disqualify the participant’s submission in the event that Samsung has reasonable grounds for believing that a selected participant has violated any of these Terms & Conditions.

Privacy Policy

• By participating in the Campaign, participants explicitly consent to Samsung storing the necessary personal data of the participant. Data is collected by our website www.mymomentlive.com, made accessible to Samsung and specifically comprises:
  • Name
  • Address
  • Pictures Uploaded
• Participants are free at any time to revoke his or her consent to the storage of data as stated above by sending an email to Samsung and in doing so to withdraw his or her participation in this Campaign.
• Samsung wishes to point out that all personal data as stated above (including General Facebook data) will not be made available to third parties.
